Terms of Use

These Terms define the conditions under which DrawSeal (the "Service" or "Platform") provides users with a tool to create and run free prize giveaways whose draw is cryptographically verifiable. Any use of the Service implies full acceptance of these Terms.

DrawSeal allows a creator (the "Organizer") to configure a giveaway, collect entries, and run a draw whose integrity is guaranteed by a provably-fair mechanism (cryptographic commitment published before the draw, public randomness supplied by the drand network).

Participation in a giveaway is and must remain free of charge for the participant. The Service is neither a game of chance for money, nor a paid lottery, nor gambling subject to specific gambling legislation: no stake, payment, or financial consideration may be required from a participant to take part in a draw, in any form whatsoever.

Access to creation features is reserved for Organizers holding an account, the creation of which implies acceptance of these Terms and, where applicable, the subscription terms in force. The Organizer warrants the accuracy of the information provided upon registration and undertakes to keep it up to date.

The user undertakes to use the Service in accordance with its purpose, applicable law, and these Terms. In particular, the user shall refrain from any fraudulent or misleading use, or any use likely to infringe the rights of third parties or the integrity of the Service.

The Service is structurally designed for free giveaways. It is accordingly strictly and expressly prohibited, in any form whatsoever, direct or indirect: any practice consisting of charging, monetizing, or financially conditioning a third party's registration or participation in a giveaway run via the Platform, as well as any circumvention, by any technical or contractual means whatsoever, of the free participation required by the Service.

Any breach of this article constitutes a material breach of these Terms. It automatically entails, without prior notice, the nullity of the giveaway concerned and the cancellation of any resulting draw, without prejudice to the measures set out in the "Sanctions and right to ban" article below, nor to any liability action the Platform reserves the right to bring.

In the event of a proven or reasonably suspected breach of these Terms — in particular the "Prohibited misuse" article — DrawSeal reserves the right to unilaterally suspend or terminate, at any time, without notice or compensation, the access of the user concerned to all or part of the Service, and to permanently ban their account.

This right is exercised without prejudice to any legal action or claim for damages for harm suffered by the Platform, other users, or third parties as a result of the breach found. Termination or suspension takes effect immediately, without the need for a prior court decision.

The DrawSeal brand, its logo, its software architecture, and all elements comprising the Platform are protected by intellectual property law and remain the exclusive property of their respective owners. No provision of these Terms shall be construed as transferring any intellectual property right to the user.

The Service is provided "as is". DrawSeal implements reasonable measures to ensure the availability, security, and integrity of the Service, without however guaranteeing uninterrupted availability. DrawSeal shall not be liable for any indirect damage, data loss, or harm resulting from use not in accordance with these Terms.

The Organizer remains solely responsible for the content of their giveaways, the prizes offered, and compliance with the regulations applicable to their activity (in particular regarding advertising, consumer protection, and protection of participants' data).

The processing of personal data of users and participants is governed by our data protection policy (GDPR), which forms an integral part of these Terms.

DrawSeal reserves the right to modify these Terms at any time, in particular to comply with any legal, regulatory, or technical change. Users will be informed of any substantial modification; continued use of the Service after the new Terms take effect constitutes acceptance thereof.

These Terms of Use are governed by Belgian law. Failing an amicable settlement, disputes as to their interpretation or performance fall within the jurisdiction of the competent Belgian courts of the publisher’s registered office.

A user acting as a consumer and residing in a European Union Member State retains, in all cases, the right to bring the dispute before the courts of their place of domicile, as well as the benefit of the mandatory provisions of the law of their country of residence. Amicable remedies are set out in the legal notice.
